This Privacy Policy applies to GroundWork - Mobile, also referred to as GroundWork, and the related GroundWork web platform located at groundwork.stevnex.com.

GroundWork is owned, operated, and provided by Stevens Construction, Inc. ("Stevens Construction," "Company," "we," "our," or "us").

GroundWork is a software platform and service of Stevens Construction, Inc. and is not a separate legal entity.

GroundWork was designed and developed by Alex Quattrone in his capacity as a technology representative of Stevens Construction, Inc. References in this Privacy Policy to GroundWork, GroundWork - Mobile, the application, the platform, the developer, or related services refer to software and services provided on behalf of Stevens Construction, Inc., unless expressly stated otherwise.

To the fullest extent permitted by applicable law, responsibilities relating to the operation, administration, privacy practices, data processing, and availability of GroundWork are responsibilities of Stevens Construction, Inc. as the operator of the service and are not intended to create personal liability for individual employees, officers, developers, administrators, contractors, or representatives acting within the scope of their responsibilities.

This Privacy Policy explains how information may be collected, processed, used, stored, and disclosed through GroundWork and how GroundWork may access certain device functionality.

By accessing or using GroundWork, users acknowledge the practices described in this Privacy Policy.

2. Purpose of GroundWork

GroundWork is a construction-focused business platform designed to support authorized business, project, administrative, workforce, technology, and communication activities.

GroundWork may include modules and functionality such as:

  • Customer Relationship Management ("CRM");

  • IT Help Desk;

  • Checklists;

  • Permit Tracking and Management;

  • Performance Reviews;

  • Training and Learning Management;

  • Asset Management;

  • NFC tag reading;

  • Barcode and QR code scanning;

  • Project and jobsite workflows;

  • Emergency Communication and Notification Services;

  • SMS text messaging;

  • Push notifications;

  • Time-sensitive notifications;

  • Critical notifications where supported and authorized;

  • Emergency hotline communications; and

  • Other construction, project, business, workforce, and administrative workflows.

Features available to an individual user may vary based on role, permissions, organization, device capabilities, and system configuration.

3. Information We Collect and Process

GroundWork collects or processes only information reasonably necessary to provide, secure, administer, support, and improve authorized application functionality.

Depending on the features used, information may include:

  • Account and authentication information;

  • Names and business contact information;

  • Email addresses;

  • Business phone numbers;

  • Company or organizational information;

  • Customer and CRM information;

  • Project and jobsite information;

  • Permit information;

  • IT help desk tickets and support information;

  • Checklist responses;

  • Training and certification records;

  • Performance review information;

  • Asset information;

  • Emergency communication information;

  • User-submitted notes, documents, images, and attachments;

  • Barcode and QR code information intentionally scanned by users;

  • NFC tag information intentionally scanned by users;

  • Location information when permission is granted;

  • Push notification identifiers;

  • Limited diagnostic or technical information necessary to operate and secure GroundWork; and

  • Other information intentionally submitted as part of an authorized GroundWork workflow.

GroundWork does not collect or use information for third-party behavioral advertising.

4. Location Services

GroundWork may request permission to access a user's device location services.

Location services may be used to improve application performance, functionality, and user experience by helping GroundWork identify or associate the user with an appropriate construction project, jobsite, property, or project address.

Location information may be used to:

  • Associate users with nearby projects or jobsites;

  • Identify applicable project addresses;

  • Improve project selection;

  • Present relevant project information;

  • Reduce manual searching;

  • Support project-specific field workflows;

  • Support location-based functionality; and

  • Improve GroundWork usability and application performance.

Depending on device settings and permissions, GroundWork may receive approximate or precise location information.

GroundWork does not use location information for third-party advertising or cross-application behavioral tracking.

Users may deny, limit, or revoke location permission through their device settings.

Certain functionality may be reduced or require manual project selection if location access is unavailable.

5. Camera Access, Barcode Scanning, and QR Code Scanning

GroundWork may request permission to access a user's device camera when required for an application feature initiated by the user.

Camera access may be used to:

  • Scan barcodes;

  • Scan QR codes;

  • Identify assets or equipment;

  • Capture project or jobsite photographs;

  • Add photographs to checklists;

  • Attach images to IT help desk requests;

  • Capture permit-related documentation;

  • Document equipment or assets;

  • Upload supporting business documentation; and

  • Support other authorized GroundWork workflows.

Information contained within a scanned barcode or QR code may be processed to identify, retrieve, create, or update an associated GroundWork record.

GroundWork does not continuously access the device camera.

GroundWork does not use camera data for behavioral advertising.

6. Photos and Images

GroundWork may allow users to capture new photographs or intentionally select existing photographs for use within the application.

Images may be associated with:

  • Projects;

  • Checklists;

  • Permit records;

  • Help desk requests;

  • Assets;

  • CRM records;

  • Training;

  • Construction documentation; or

  • Other authorized business workflows.

GroundWork does not intentionally retrieve photographs that a user has not selected, captured, submitted, or otherwise authorized the application to access.

Images intentionally uploaded to GroundWork may become part of the applicable business or project record.

7. NFC Reading

GroundWork may use compatible mobile device Near Field Communication ("NFC") functionality.

NFC may be used for authorized workflows involving:

  • Assets;

  • Equipment;

  • Inventory;

  • Devices;

  • Project resources;

  • Locations;

  • Jobsite equipment; or

  • Other GroundWork records.

When a user initiates an NFC scan, GroundWork may read information stored on a compatible NFC tag and use that information to identify or retrieve a corresponding GroundWork record.

GroundWork does not use NFC scanning for advertising or cross-application tracking.

GroundWork does not intentionally perform continuous background NFC scanning.

8. Push Notifications

GroundWork may request permission to send push notifications to the user's device.

Notifications may include:

  • Project updates;

  • Permit updates;

  • IT help desk notifications;

  • Checklist assignments;

  • Checklist reminders;

  • Performance review notices;

  • Training assignments or reminders;

  • Asset-related notices;

  • Business communications;

  • Emergency alerts;

  • Safety alerts;

  • Weather notifications;

  • Company announcements;

  • Workflow notifications; and

  • Other authorized GroundWork communications.

GroundWork may use Apple Push Notification service ("APNs") or other authorized notification infrastructure to provide these messages.

A device-specific notification token or similar identifier may be processed to route notifications to the correct device.

Notification identifiers are not used by GroundWork for behavioral advertising.

9. Time-Sensitive and Critical Notifications

GroundWork may request permission to deliver notifications designated by Apple as time-sensitive.

Where technically available, authorized by Apple, and permitted by the user, GroundWork may also request permission to deliver critical alerts.

These notification types may be used for particularly important communications such as:

  • Emergency conditions;

  • Severe weather;

  • Jobsite safety events;

  • Office or jobsite closures;

  • Operational emergencies;

  • Security incidents;

  • Business continuity events; and

  • Other urgent communications where timely delivery is important.

GroundWork does not use time-sensitive or critical notifications for third-party advertising.

Users may manage applicable notification permissions through their operating system settings, subject to Apple requirements.

10. SMS Text Messaging

GroundWork may provide SMS text messaging functionality for authorized business and emergency communications.

Where SMS functionality is used, GroundWork may process a user's phone number for the purpose of sending messages.

SMS communications may include:

  • Emergency alerts;

  • Severe weather alerts;

  • Safety information;

  • Company communications;

  • Project information;

  • Operational notices;

  • Training notices; and

  • Other authorized communications.

GroundWork does not sell phone numbers or use them for third-party behavioral advertising.

Standard carrier messaging or data charges may apply.

11. Emergency Communication and Hotline Services

GroundWork may provide emergency communication functionality through push notifications, SMS, hotline messages, or other authorized communication channels.

Emergency communication services may provide information concerning:

  • Severe weather;

  • Emergency conditions;

  • Safety incidents;

  • Office closures;

  • Jobsite closures;

  • Operational disruptions;

  • Security events;

  • Emergency instructions; and

  • Other important organizational communications.

GroundWork does not guarantee that emergency messages will always be delivered, received, read, or acted upon within any specific period of time.

Users should not rely on GroundWork as their sole source of emergency information.

Emergency services such as 911 and official governmental alerts should be used where appropriate.

12. GroundWork Modules

CRM

The CRM module may process business development, customer, contact, opportunity, company, project, and related communications information.

IT Help Desk

The IT Help Desk may process:

  • User identity information;

  • Device information voluntarily provided;

  • Issue descriptions;

  • Troubleshooting details;

  • Attachments;

  • Images;

  • Ticket activity; and

  • Support history.

Checklists

Checklist functionality may process:

  • Responses;

  • Selections;

  • Comments;

  • Files;

  • Images;

  • Completion information;

  • User identity;

  • Date and time information; and

  • Other information required for the applicable checklist.

Permits

Permit functionality may process:

Photos

Used to allow users to select or upload photographs and images.

NFC

Used to read compatible NFC tags when a user initiates an applicable workflow.

Push Notifications

Used to deliver application, business, workflow, emergency, and safety communications.

Time-Sensitive Notifications

Used for communications requiring prompt attention.

Critical Alerts

Where approved, supported, and permitted, used for urgent safety or emergency communications.

Users control applicable permissions through their device operating system.

16. Third-Party Service Providers

GroundWork may use third-party infrastructure and service providers to operate the application.

19. Advertising and Tracking

GroundWork does not display third-party behavioral advertising.

GroundWork does not use GroundWork information to track users across unrelated third-party applications or websites for behavioral advertising.

GroundWork does not use:

  • Location information;

  • NFC information;

  • Barcode information;

  • Photographs;

  • Notification tokens;

  • Account information; or

  • Business records

for third-party behavioral advertising.

20. Data Security

Stevens Construction uses reasonable administrative, technical, and organizational measures designed to protect information handled by GroundWork.

Security measures may include:

  • Authentication;

  • Role-based access;

  • Secure network communications;

  • Encryption where appropriate;

  • System monitoring;

  • Logging;

  • Access restrictions;

  • Administrative controls; and

  • Other reasonable security measures.

However, no electronic system, mobile application, server, network, database, transmission method, or storage system is completely secure.

Stevens Construction, GroundWork, and their employees, officers, representatives, developers, or service providers cannot guarantee that unauthorized access, security incidents, technical failures, or data loss will never occur.

21. Data Accuracy

GroundWork may contain information entered or uploaded by users, administrators, third parties, governmental entities, external systems, or integrations.

Stevens Construction and GroundWork do not guarantee that all information available through GroundWork is complete, current, error-free, or accurate.

Users are responsible for verifying information when accuracy is important to a business, construction, safety, employment, regulatory, permitting, or legal decision.

22. Data Retention

Information may be retained for as long as reasonably necessary to:

  • Operate GroundWork;

  • Maintain business records;

  • Maintain customer records;

  • Maintain project documentation;

  • Maintain permit records;

  • Maintain IT support records;

  • Maintain checklist records;

  • Maintain training records;

  • Maintain performance review records;

  • Maintain asset records;

  • Maintain emergency communication records;

  • Comply with contractual obligations;

  • Maintain audit or security records;

  • Resolve disputes;

  • Comply with legal requirements; and

  • Meet legitimate organizational recordkeeping requirements.

Information may be deleted, archived, anonymized, or retained according to applicable business, legal, contractual, or regulatory requirements.

Users should not assume that information entered into a business system is private from authorized administrators or personnel who require access for legitimate business purposes.

25. User Responsibilities

Users are responsible for:

  • Maintaining the confidentiality of their account credentials;

  • Using GroundWork only for authorized purposes;

  • Following company policies;

  • Obtaining required authorization before uploading third-party information;

  • Ensuring information they submit is appropriate for the system;

  • Avoiding unauthorized disclosure of confidential information; and

  • Promptly reporting suspected security or access issues.

Users should not attempt to bypass GroundWork security, permissions, authentication, or access controls.

26. Application Availability

GroundWork is provided as a business application and may periodically be unavailable because of:

  • Maintenance;

  • Updates;

  • Network outages;

  • Third-party service failures;

  • Internet connectivity;

  • Device limitations;

  • Server failures;

  • Software defects;

  • Security incidents;

  • Events outside the reasonable control of Stevens Construction; or

  • Other operational circumstances.

Stevens Construction does not guarantee uninterrupted or error-free operation of GroundWork.

27. Disclaimer of Warranties

To the fullest extent permitted by applicable law, GroundWork and GroundWork - Mobile are provided on an "as is" and "as available" basis.

Stevens Construction does not make warranties, express or implied, regarding:

  • Continuous availability;

  • Accuracy;

  • Reliability;

  • Completeness;

  • Compatibility;

  • Fitness for a particular purpose;

  • Error-free operation; or

  • Suitability for any particular legal, construction, permitting, employment, safety, or business decision.

GroundWork is intended to support business workflows and is not a substitute for professional legal, engineering, architectural, safety, regulatory, medical, or emergency advice.

28. Limitation of Liability

To the fullest extent permitted by applicable law, Stevens Construction, Inc., GroundWork, GroundWork - Mobile, and their officers, directors, employees, agents, administrators, developers, contractors, service providers, representatives, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to:

  • Use of GroundWork;

  • Inability to use GroundWork;

  • Application downtime;

  • Data loss;

  • Delayed notifications;

  • Notification delivery failures;

  • SMS delivery failures;

  • Emergency communication failures;

  • Errors or inaccuracies in information;

  • Third-party services;

  • Network failures;

  • Device failures;

  • Unauthorized access; or

  • Other circumstances outside reasonable control.

Nothing in this section excludes liability that cannot legally be excluded under applicable law.

29. Individual Developer and Employee Protection

GroundWork was designed, developed, administered, maintained, or supported by employees and representatives acting on behalf of Stevens Construction, Inc., including Alex Quattrone.

To the fullest extent permitted by applicable law, use of GroundWork does not create a separate contractual, fiduciary, professional, or individual duty between a GroundWork user and Alex Quattrone or any other individual employee, developer, administrator, officer, or representative of Stevens Construction.

Any actions taken by Alex Quattrone or other personnel in connection with designing, developing, supporting, maintaining, administering, or operating GroundWork are undertaken on behalf of Stevens Construction within the applicable scope of their employment, responsibilities, or authorization.

Nothing in this Privacy Policy is intended to create personal liability for Alex Quattrone or any other individual acting on behalf of Stevens Construction beyond liability that cannot legally be excluded.

30. Indemnification

To the extent permitted by applicable law and applicable agreements, users are responsible for their unauthorized, unlawful, or improper use of GroundWork.

Nothing in this Privacy Policy is intended to expand any indemnification obligation beyond obligations established by applicable law, contract, employment agreement, company policy, or other binding agreement.

GroundWork is intended for authorized business use and is not designed for children.

34. Changes to GroundWork

Stevens Construction may:

  • Modify functionality;

  • Remove functionality;

  • Change integrations;

  • Change service providers;

  • Update GroundWork; or

  • Discontinue GroundWork or individual features

at its discretion, subject to applicable contractual and legal obligations.

  • Apple Push Notification service;

  • Notification permissions;

  • Critical alerts;

  • Device functionality;

  • Diagnostics; and

  • Other Apple services

according to Apple's own privacy practices.

Stevens Construction does not control information independently collected or processed by Apple.

Apple is not responsible for Stevens Construction's or GroundWork's privacy practices.

37. Third-Party Platforms and Integrations

GroundWork may integrate or exchange information with other authorized software platforms or services.

Information exchanged with third-party platforms may be subject to:

Stevens Construction is not responsible for independent data processing performed by a third party outside of Stevens Construction's control.
